1. What this is about
KleinerWichtel.de helps groups with Secret Santa: create a group, invite people, write wishlists and have the draw decide who gives a present to whom. The site is run by a private individual (see the legal notice), not for profit and without advertising. These terms apply to everyone who uses KleinerWichtel.de.
2. Free of charge, no guaranteed availability
Using the site is free, and it will stay that way. There is no right to the site being available at all times or keeping particular features. Maintenance, disruptions or outages can happen. If KleinerWichtel.de shuts down, I will announce it by email at least four weeks in advance so you can save your wishlists.
3. Your account
For an account you need an email address that belongs to you and a name your group recognises you by. You may create an account if you are at least 16 years old; younger people need their parents’ consent. Keep your password secret. If you use two-factor sign-in, keep the reset code somewhere safe. If you notice that someone else has access to your account, please change your password right away and let me know.
4. Groups and invitations
Whoever creates a group organises it: sending invitations, managing members, setting the rules and starting the draw. Only invite people you know and who expect an invitation – family, friends or colleagues, for example. The number of invitations is capped so the site cannot be misused for mass email. Anyone who receives an invitation they did not expect can report it through the link in the email.
5. Your content
Names, wishes, links and pictures you post remain yours. You only allow me to store them and show them to the members of your groups – nothing more, and only for as long as that requires. What stays visible after you delete your account, and for how long, is set out in the privacy policy. Only post content you have the rights to and that is not unlawful, insulting, pornographic or hurtful in any other way. Please post photos of other people only with their consent. Content that breaks these rules may be removed.
6. What is not allowed
KleinerWichtel.de is for Secret Santa. In particular, the following is not allowed: – advertising or spam, including through group names, wishes or invitations, – invitations to strangers or to addresses that do not belong to a real person, – automated access (bots, scrapers) and attempts to overload the site, – attempts to get around security measures or to access other people’s accounts. If you find a security issue, I am glad to hear about it at the address in the legal notice.
7. The gift exchange itself
KleinerWichtel.de runs the draw and keeps the wishlists. Presents, meetings and arrangements are up to the group. I do not sell anything and have no part in any present. Links in wishlists lead to other sites, whose content is the responsibility of their providers.
8. Ending your account and blocking
You can stop using the site at any time and delete your account yourself, in your profile under “Delete account”. Before you do, the page shows what will happen to your groups. If someone breaks these terms or content is unlawful, I may remove content and block or delete the account. I decide case by case and take into account how serious the breach is. If I remove content of yours or block your account, you will receive an email with the reason; this does not apply to accounts obviously created only for spam. A blocked account is signed out and can no longer sign in. If you think a decision is wrong, write to the address in the legal notice. I will then take another look and tell you how I decided.
9. Liability
I am liable without limit for damage I cause intentionally or through gross negligence, for injury to life, body or health, and under the Product Liability Act. For slight negligence I am only liable if I breach an essential obligation – one without which KleinerWichtel.de could not be used sensibly and on which you may rely. Liability is then limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
10. Privacy
Which data is stored, why and for how long is set out in the privacy policy.
11. Changes to these terms
If the terms change, you will receive the new version by email at least four weeks before it takes effect. If you do not agree, you can delete your account before then.
12. Applicable law
German law applies. If you live in another EU country, you keep the protection of the mandatory consumer protection laws of your country. This English version is a translation; the German version is binding. Last updated: October 2026
